Funding Cycles and Why Time Matters

Please do not delay if you are eligible and your documents are ready.

Funding is limited and processed in cycles. Complete applications move faster because missing documents and incorrect information create delays. If you are eligible and your documents are ready, submit your application now.

SCOPE OF WORK, CHANGE ORDERS, AND CONTRACT COMPLETION

IMPORTANT: This acknowledgment covers Motivative Consulting LLC contractor scope, change-order, and completion terms. It does not change USDA or VA eligibility requirements, program rules, or agency approval decisions. 1. ITEMIZED SCOPE OF WORK
An Itemized Scope of Work shall be attached to and incorporated into this Bid and Contract. Only the labor, materials, repairs, and services specifically listed in the Itemized Scope of Work are included in the Contract Price. Any item, condition, repair, material, or service not specifically listed is excluded from this Contract, regardless of whether it is visible, discovered during construction, located near the contracted work, or requested after work begins.

2. OWNER’S RESPONSIBILITY TO REVIEW SCOPE
Before work begins, the Owner shall review, approve, initial, and sign the Itemized Scope of Work. The Owner’s signature confirms that the written list accurately states the work the Contractor has agreed to perform for the Contract Price. No verbal statement, conversation, assumption, photograph, inspection, or general description shall expand the Contractor’s responsibilities beyond the written Itemized Scope of Work.

3. UNFORESEEN AND CONCEALED CONDITIONS
The Contract Price does not include concealed, hidden, unforeseen, or additional damage discovered after work begins, including but not limited to rotten wood, structural deterioration, mold, termite damage, plumbing problems, electrical problems, subfloor damage, framing damage, code-related corrections, or damage hidden behind walls, ceilings, floors, trim, cabinets, roofing, or other materials. When an unforeseen condition is discovered, the Contractor may stop work in the affected area, photograph and document the condition, and provide the Owner with a written Change Order stating the additional work, price, materials, and any additional time required.

4. NO ADDITIONAL WORK WITHOUT A WRITTEN CHANGE ORDER
The Contractor is not required to perform any work outside the signed Itemized Scope of Work. All additional work must be authorized through a written Change Order signed by both the Owner and Contractor before the additional work begins. The Change Order must state the additional or revised work requested, the additional labor and material charges, any Contractor overhead or administrative charge, any required deposit, and any extension of the completion date. Verbal requests and unsigned agreements shall not authorize additional work. The Contractor may refuse or postpone additional work until the Change Order is signed and the required payment or deposit is received.

5. PROGRESS INSPECTION AND SIGN-OFF
The Itemized Scope of Work shall include a space for the Owner to initial or sign as each listed phase or work item is completed. The Owner agrees to inspect completed items promptly and either sign or initial that the item has been completed or provide a specific written explanation identifying an incomplete or defective part of that listed item. The Owner may not refuse to approve completed contracted work because of a condition, repair, or requested service that is not included in the signed Itemized Scope of Work.

6. CONTRACT COMPLETION
When all items listed in the signed Itemized Scope of Work and all signed Change Orders have been completed, the Contractor’s obligations under this Contract are fulfilled, and the remaining Contract Balance becomes immediately due according to the payment schedule. Requests involving unrelated areas, newly discovered conditions, cosmetic preferences, additional repairs, upgrades, or work not listed in the original Scope of Work shall not delay final approval or payment for completed contracted work.

7. COMPLETION NOTICE AND OBJECTIONS
Upon receiving notice that a listed phase or the entire project is complete, the Owner shall inspect the work and identify any alleged deficiency in the contracted work in writing within three calendar days. The written notice must identify the specific numbered scope item and clearly describe the alleged deficiency. Conditions or requested work outside the signed Scope of Work shall not constitute a deficiency and shall not be used as a reason to withhold approval or payment.

8. ADDITIONAL WORK AFTER COMPLETION
After the original Scope of Work is completed, no additional repair, return visit, adjustment, or service shall be performed without a separate written agreement and additional fee, except for a verified correction covered by an express written workmanship warranty. The Contractor is not responsible for providing free labor or materials for conditions or requests that were not included in the original Contract or an approved Change Order.

9. NO WAIVER
If the Contractor voluntarily performs a minor courtesy item without charge, that courtesy shall not modify the Contract, expand the Scope of Work, establish a continuing obligation, or require the Contractor to perform other additional work without compensation.

OWNER ACKNOWLEDGMENT
I have reviewed the Itemized Scope of Work. I understand that only the listed work is included in the Contract Price. I further understand that additional, concealed, unforeseen, or requested work requires a separately priced written Change Order and may extend the completion date.
